Vail Film Festival 2007 Sweepstakes — Official Rules NO PURCHASE NECESSARY. No payment of any kind is necessary to enter or win this sweepstakes. You are not a winner yet. Odds of winning: 1 out of the total number of eligible entries received. The sponsor of the sweepstakes is Colorado Film Institute Inc. (“VFI”). To enter, log on to http://www.vailfilmfestival.org/sweepstakes and enter your email address. Internet access is required to enter. Sweepstakes begins 12/01/06 12:01 am ET and entries must be received by 02/01/07 11:59 pm ET to be eligible to win. Only entries submitted electronically to the Web site in accordance with these rules will be eligible for consideration. Only one entry per email address per person. You may enter under one name and one e-mail address only. The entries will be deemed to have been submitted by the authorized account holder of the e-mail address submitted at the time of the entry. “Authorized account holder” is defined as the natural person who is assigned to an e-mail address by an Internet access provider, online service provider or organization (e.g., business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. Entries that are mechanically reproduced, contain inaccurate information, do not fully comply with these rules or that are lost, late, incomplete, illegible, unintelligible, damaged or otherwise not received by VFI, in whole or in part, due to computer, human or technical error of any kind are not eligible. Entries cannot be acknowledged or returned and become the property of VFI upon receipt. Participants must follow all instructions to enter. From all eligible entries received, VFI will randomly select the winner on or about 02/02/07. Winner will be notified by e-mail on or about 02/03/07. When winner is notified by e-mail, the winner must reply with all contact information requested in the notification within five (5) days from the date notification e-mail was sent, or another winner may be selected. Winner will be obligated to sign and return an Affidavit of Eligibility, and Release of Liability, unless prohibited by law, within 14 days of e-mail notification. In the event of noncompliance within this time period, if the potential winner cannot be reached at the email on his or her entry, or if a prize or prize notification is returned as unclaimed or undeliverable for whatever reason, the winner will forfeit any right to receive the prize and an alternate winner may be selected. Winner selection is under the supervision of VFI, whose decisions are final. Entrants agree to be bound by these Official Rules and the decisions of VFI. Sweepstakes open only to legal residents of the 50 United States, and District of Columbia who are 18 years of age or older. Employees of VFI and members of their immediate families & household members are not eligible. Sweepstakes subject to all federal, state and local laws and is void wherever prohibited by law. Any prize or prize notification returned to VFI as undeliverable may result in the awarding of that prize to an alternate winner from among the other eligible entries submitted. By entering the sweepstakes, entrants will be sharing their email address with VFI. Email addresses collected by VFI will be used for administration of the sweepstakes. The prize will be awarded to one winner. Any unclaimed and/unused portion of prize package will be forfeited and will not be substituted. All expenses not specifically listed herein are the winner's responsibility including, but not limited to, airfare, sales taxes, gratuities, ground transportation to/from winner's residence to/from airport, and all incidental expenses. Winner and travel companion are responsible for any damages to accommodations (e.g., hotel), vehicles (e.g., planes, limousines, buses, rental cars, etc.) or premises (e.g., restaurants, nightclubs, concert venues, etc.), or any persons occupying such accommodations, vehicles or premises that arise from the acts or failure to act of the winner and/or travel companion. All federal, state and local taxes are the sole responsibility of the winner. Winner will be sent an IRS Federal 1099-MISC tax form for the retail value of any prize at or above $600. No transfer or substitution of prize permitted, except that VFI reserves the right to substitute a prize of equal or greater value in the event that the offered prize is unavailable. In the event The Vail Film Festival is canceled or postponed for any reason, VFI reserves the right to award the hotel portion of the prize without VIP passes to the film festival. All prizes will be awarded within 2 months of receipt of valid and executed winners’ affidavit or prize confirmation. However, any portion of the prize not accepted by the winner will be forfeited. VFI shall not have any obligation or responsibility with regard to (i) entries that contain inaccurate information or do not comply with these rules, (ii) entries, prize claims or notifications that are lost, late, incomplete, illegible, unintelligible, damaged or otherwise not received by the intended recipient, in whole or in part, due to computer, human or technical error of any kind, (iii) telephone, electronic, hardware, software, network, Internet or computer malfunctions, failures or difficulties, (iv) any inability of the winner to accept the prize for any reason; (v) if a prize cannot be awarded due to travel cancellation, delays or interruptions due to Acts of God, natural disasters, terrorism or weather; or (vi) any damages or losses of any kind caused by any prize or resulting from awarding, acceptance, possession, use, misuse, loss or misdirection of any prize or resulting from participating in this promotion or any promotion or prize related activities. VFI, in its sole discretion, reserves the right to disqualify any person tampering with the entry process or the operation of this promotion or otherwise violating these rules. If VFI determines, in its sole discretion, that technical difficulties or unforeseen events outside its control compromise the integrity or viability of the promotion, VFI reserves the right to void the entries at issue, modify the promotion and/or terminate the relevant portion of the promotion.
